General Terms and Conditions for TestNow™

By accessing or using TestNow™, the OpenEDG online exam delivery platform, you agree to these Terms and Conditions (“Terms”). If you do not agree, do not use TestNow.

1. About TestNow

TestNow™ is an online testing and exam delivery system operated by Open Education and Development Group and/or its affiliates (“OpenEDG,” “we,” “us,” “our”). TestNow enables users to access, take, and complete certification and assessment exams.

2. Eligibility and Use by Minors

You must be legally able to enter into a binding agreement to use TestNow. Minors may use TestNow only with the consent and supervision of a parent or legal guardian, and in accordance with applicable laws (including COPPA and GDPR/UK GDPR where applicable).

3. Accounts and Security

• You must provide accurate and current information.
• You are responsible for maintaining the confidentiality of your login credentials.
• You are responsible for all activity that occurs under your account.
• Notify us immediately of any unauthorized access or security concerns.
• Where available, we strongly recommend enabling multi-factor authentication (MFA).

4. Exams, Delivery, and Integrity

• TestNow may deliver exams, assessments, and related services.
• Exam-specific rules, candidate agreements, and program terms apply and are incorporated by reference.
• Cheating, impersonation, sharing exam content, using unauthorized aids, or attempting to bypass exam controls is strictly prohibited.
• Exams may be monitored or proctored using human and/or automated tools, including identity verification and integrity monitoring.
• Violations may result in invalidation of results, suspension, or termination of access.

5. Acceptable Use

• Violate any applicable law or regulation;
• Interfere with the operation or security of TestNow;
• Attempt to access exams, data, or systems without authorization;
• Circumvent exam delivery, proctoring, or security mechanisms;
• Upload malware or engage in automated scraping or harvesting.

6. Intellectual Property

All content, software, exams, trademarks, logos, and materials available through TestNow are owned by OpenEDG or its licensors and are protected by intellectual property laws. You may not copy, reproduce, distribute, or modify any part of TestNow except as expressly permitted.

7. Limited License

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use TestNow solely for your personal, non-commercial exam and assessment purposes.

8. User Submissions

If you submit feedback or other content through TestNow, you represent that you have the right to do so. You grant OpenEDG a limited license to use such content solely to operate, support, and improve TestNow. Nothing in this section overrides applicable student or educational data protections.

9. Third-Party Services

TestNow may integrate third-party services (e.g., payment processing, proctoring, analytics). Any links to third-party websites or information provided through TestNow are offered for convenience only. Such third-party websites and services are not under the control of OpenEDG, and OpenEDG is not responsible for their content, availability, security, or use. The inclusion of any link or third-party information does not imply endorsement by OpenEDG of the linked websites, services, organizations, or their products.

10. Privacy and Data Protection

Your use of TestNow is subject to our Privacy Policy and Cookie Policy, which explain how personal data is collected, used, and protected. We do not sell personal data. Exam and educational data is handled in accordance with applicable laws and regulations.

11. Fees and Payments

Exam fees, vouchers, and payment terms are presented at purchase or through your organization. Refunds, if any, are governed by the applicable exam, voucher, or program terms.

12. Availability and Changes

We may modify, suspend, or discontinue parts of TestNow at any time. We do not guarantee uninterrupted or error-free availability.

13. Disclaimers

TestNow is provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim all warranties, express or implied, including fitness for a particular purpose and non-infringement.

14. Limitation of Liability

To the maximum extent permitted by law, OpenEDG will not be liable for indirect, incidental, consequential, or punitive damages arising from your use of TestNow. Our total liability will not exceed the amount paid by you (if any) for the relevant exam or service.

15. Suspension and Termination

We may suspend or terminate access to TestNow if you violate these Terms, applicable law, or exam rules, or if your use poses a risk to the platform or others.

16. Governing Law

These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-law principles, unless otherwise required by applicable law.

17. Changes to These Terms

We may update these Terms from time to time. Continued use of TestNow after changes take effect constitutes acceptance of the updated Terms.
